Uncle Bub's BBQ has been in business up in the Chicago area for over 16 years. I believe the owner is KCBS #100, so he has been at it from early on....

Man, you're not lying about your team name being associated with some very big contests! (that one over the river in Indiana a few times; that one in a dry county in Tennessee.......). Hang in there, Chad!
 
Currently forming a new BBQ team and going through the naming process. It is difficult when there is no official list of teams.

We have a team name (we arrived @ on our own) but it looks like there use to be a team that used that name but they haven't competed since 2011 and about 6 states away. It's not trademarked nor is it listed on the KCBS site - would using this name be in bad taste given the circumstances?

yes.. yes it is.. it is to me.. I've had this name for 10 years, I am associated with it.. Having someone able to trademark it, then potentially tell me I can't use it again, well, it feels like having part of your identity stolen and the federal court says it's ok. Competition BBQ has nothing to do with it. There's another moonswiners that competes in the Midwest, and a franklin co. moonswiners in the east..Been this way for a few years or more.. But I was the first. I'd like to think there is some sort of unwritten code with us BBQ'ers, a brotherhood, so I was just going to turn a blind eye to that and not be an ass.. Even though I disagree with other teams using it, I just let it go. But, when a company decides to use it, and trademark it, and all it would have took was a 30 second google search to determine it was me on the first 10 pages, I'd thought they'd at least try that, see this, and do something else.. but no... So, yes, I am fighting it.

you'd be surprised just by googling things. Team names pop up if they got called.

I think it gets far past competition BBQ and gets in to the area of stealing a persons identity and reputation. It just isn't that hard to find out that there is a Moonswiners, and that it has been used for a while.

When I started my company out here in CA, we wanted to call ourselves SFE. It took a very short amount of time to find that there were several SFE firms out there, so we changed to SFE Design, which was significantly different as the other firms were not design firms. But, if there had been a SFE Design firm, we would never have stolen their name.

Moonswine is a great play on words, at the very least, the person who has had beneficial and regular use of the name should have control over it.

I feel bad for Podge as a member, but on the flip side, if the name was that important, especially after winning such a prestigious contest a few years back, it should have been trademarked at the time to protect it.

While Google is a great resource to do a search to see what pops up on the first page or two for potential conflict, an argument can certainly be made that having a lawyer check the legal channel is the right way to go vs. Google especially if you are thinking more locally that you know there were no other businesses in your area with the name but want to check to cover yourself nationally.

Sucks but I can see both sides here.

Now, tell me.. who in the hell thinks of Trademarking their name after winning something big??!?!!?!?... It's BBQ... People trademark things when they own a company.. not to just spend money on something that might not mean much to anybody else.. Took 7 years from winning the jack until someone stumbled upon my name.

I get the personal attachment and realize you might not think to have a need to trademark it...
Strange thing here is that the restaurant in question was trying to get away from the exact same issue of another restaurant with same name and it causes this.

I can only go by what I read, but it doesn't seem like it was a blatant attempt to steal... at least based on what the article says.

Approximately 4,000 entries were submitted during a contest last year to rename Dale's West. Lindsey Jackson of Fort Pierce submitted the winning name and wins free barbecue for a year, a prize worth $1,040.

I hope you have a legit case and can win.
